Table Quest TERMS OF USE
(END-USER AGREEMENT)

INTRODUCTION
Welcome to Table Quest, an online restaurant reservation and pre-order platform operated by Viditrack EOOD (“Table Quest”, “we”, “our”, or “us”). Viditrack EOOD is a company incorporated under the laws of the Republic of Bulgaria (Company No. 207864476), with its registered office at 68 Raiko Daskalov Street, Floor 2, Office 8, 4000 Plovdiv, Bulgaria.
These Terms of Use (“Terms”) constitute a legally binding agreement between you (“User” or “you”) and Table Quest. They govern your access to and use of the Table Quest website, mobile applications, and all related services, including making restaurant reservations, placing pre-orders, and processing payments (collectively, the “Platform” or “Services”).
By creating a Table Quest account, clicking “I Agree,” or otherwise accessing or using our Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not accept these Terms, you must not use the Platform.
- SCOPE OF SERVICES AND OUR ROLE
- Intermediary nature. Table Quest is an intermediary platform, as defined by EU rules for online intermediation services. We provide an online marketplace that allows users to connect with participating restaurants (“Restaurant Partners” or “Restaurants”) to make reservations and pre-order meals.
- No service provision by Table Quest. Table Quest is not a restaurant, caterer, or food service provider. We do not prepare, supply, or serve food or beverages, nor do we act as your agent in relation to dining services. When you make a reservation or pre-order via the Platform, you enter into a direct contract with the Restaurant for the provision of food and beverage services. Table Quest is not a party to that contract.
- Limited agency for payments. For payment facilitation purposes, Restaurant Partners appoints Table Quest (and its payment processor, Stripe) as their limited payment collection agent. When you pay through the Platform, your payment obligation to the Restaurant is deemed fulfilled. Beyond this payment role, nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between Table Quest and any Restaurant Partner.
- Restaurant responsibility. Restaurants are solely responsible for:
- the quality, safety, and suitability of the dining experience and menu items;
- compliance with applicable health, safety, and consumer protection laws; and
- the accuracy of their listings, including menus, pricing, and availability.
- Table Quest’s role. We facilitate transactions by enabling reservations and transmitting pre-orders to Restaurants, collecting and remitting payments on behalf of Restaurants, and providing the Platform’s technical infrastructure, notifications, and customer support.
- No guarantees. While we seek to partner only with reputable Restaurants, Table Quest makes no guarantee or warranty as to the availability, performance, or quality of any Restaurant, nor the safety, suitability, or accuracy of any menu items or dining services.
- Intermediary nature. Table Quest is an intermediary platform, as defined by EU rules for online intermediation services. We provide an online marketplace that allows users to connect with participating restaurants (“Restaurant Partners” or “Restaurants”) to make reservations and pre-order meals.
- ACCOUNT REGISTRATION AND ACCEPTANCE OF TERMS
- Eligibility. To access the Services, you must create a User Account or, where expressly permitted, use the Platform as a guest. Access to account registration and payment functionalities is strictly limited to individuals who are at least eighteen (18) years of age, or the age of legal majority in their jurisdiction of residence, whichever is higher.
- Accuracy of Information. You agree to provide truthful, accurate, and complete information during registration and to keep such information – including contact and payment details – current and up to date at all times.
- Account Security. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your Account, whether or not authorized by you. Table Quest strongly recommends using robust passwords and secure access methods.
- Consent and Acceptance. By selecting the acceptance checkbox (or by taking any equivalent action presented on the Platform), you acknowledge and agree to be bound by these Terms. Such action constitutes your electronic signature and creates a valid, binding contractual agreement between you and Table Quest.
- Prohibited Conduct. You shall not:
- create more than one User Account;
- impersonate any other person or entity, or misrepresent your affiliation with any person or entity;
- provide false, misleading, or fraudulent information.
- Suspension and Termination. Table Quest reserves the right, in its sole discretion and without prior notice, to suspend or terminate your Account in the event of:
- the submission of inaccurate, incomplete, or fraudulent information,
- suspected or actual fraudulent or abusive activity, or
- any violation of these Terms.
- Eligibility. To access the Services, you must create a User Account or, where expressly permitted, use the Platform as a guest. Access to account registration and payment functionalities is strictly limited to individuals who are at least eighteen (18) years of age, or the age of legal majority in their jurisdiction of residence, whichever is higher.
- MAKING RESERVATIONS AND PRE-ORDERING
- Reservation Process. Through the Platform, you may search participating Restaurants, view menus, and place reservations for available dates and times. Upon completing a reservation, you will receive a confirmation through the Platform and/or via email. The confirmation will specify, at a minimum, the Restaurant name and address, the date and time of the booking, the number of guests, any pre-ordered menu items, and the applicable cancellation and no-show policy.
- Legitimate Bookings. By placing a reservation, you represent and warrant that you intend to honor it in good faith. You agree not to:
- make duplicate or speculative reservations;
- reserve multiple Restaurants for the same mealtime;
- otherwise misuse or manipulate the booking system.
- Cancellation Obligations. If your plans change, you are required to cancel your reservation in strict accordance with the applicable Restaurant’s cancellation or no-show policy. Failure to do so may result in penalties as set forth by the Restaurant and/or by Table Quest.
- Pre-Ordering of Menu Items. Certain Restaurants may allow or require you to pre-order dishes, set menus, or other items at the time of booking. Such pre-order constitutes a binding order for goods and/or services to be provided at the scheduled reservation time. The Restaurant shall prepare and make the pre-ordered items available, subject to reasonable exceptions (e.g., unexpected unavailability, in which case the Restaurant will notify you and propose alternatives).
- Commitment to Purchase. By submitting a pre-order, you commit to purchasing those items upon your arrival at the Restaurant. Additional items ordered during your visit are separate transactions and shall be billed directly by the Restaurant.
- Purpose of Pre-Ordering. Pre-ordering is designed to facilitate the Restaurant’s preparation, to secure availability for you as a guest, and to establish a mutual commitment between you and the Restaurant regarding the items selected.
- Reservation Process. Through the Platform, you may search participating Restaurants, view menus, and place reservations for available dates and times. Upon completing a reservation, you will receive a confirmation through the Platform and/or via email. The confirmation will specify, at a minimum, the Restaurant name and address, the date and time of the booking, the number of guests, any pre-ordered menu items, and the applicable cancellation and no-show policy.
- PRICING AND PAYMENT
- Restaurant-Determined Prices. All menu prices displayed on the Platform are established solely by the respective Restaurants. Prices are indicated in Euro (EUR) or, where applicable, the local currency, and include VAT or other sales taxes unless expressly stated otherwise. If your payment method’s currency differs from the currency displayed on the Platform, your card issuer’s exchange rate and any associated fees may apply. Minor rounding differences may occur. Table Quest does not apply any currency conversion fee to Users.
- Breakdown of Charges. Before confirming any pre-order, you will be presented with a clear breakdown of all applicable charges. Table Quest does not impose any additional service fee on Users for making a reservation. The amount payable corresponds exclusively to the pre-ordered items displayed at the time of booking. Gratuities remain entirely at your discretion and are settled outside of the Platform.
- Payment Obligation. Payment for pre-ordered items is generally required at the time of booking in order to secure your reservation, unless a Restaurant’s policy permits deferred payment. By confirming a reservation with a payment requirement, you expressly authorize Table Quest and its designated payment processor to charge your selected payment method for the total amount due.
- Payment Processing via Stripe
- All payments are securely processed by Stripe, an independent PCI-DSS compliant payment service provider.
- Table Quest does not store your full card details.
- Transactions may appear on your bank statement under “Table Quest,” “Viditrack,” or a substantially similar descriptor.
- By submitting your payment information, you agree to Stripe’s applicable cardholder terms of service and privacy policy. You are not entering into a Stripe Connected Account agreement.
- Agency Role of Table Quest. Table Quest, acting through Stripe, collects payments as the authorized agent of the respective Restaurant. Your payment obligation to the Restaurant is deemed satisfied once the payment has been successfully processed. This arrangement is legally equivalent to making a payment directly to the Restaurant.
- Payment Confirmation. Upon successful processing of your payment, you will receive an on-screen and/or email confirmation. Such confirmation serves as valid proof of payment and finalizes your reservation and pre-order. The Restaurant will be simultaneously notified. Funds are subsequently held and remitted to the Restaurant after your reservation date, net of any commission or fees payable to Table Quest by the Restaurant.
- Failed Transactions. If a payment attempt is declined or otherwise fails, your reservation request shall not be completed. You will be required to provide an alternative payment method to secure your booking.
- Restaurant-Determined Prices. All menu prices displayed on the Platform are established solely by the respective Restaurants. Prices are indicated in Euro (EUR) or, where applicable, the local currency, and include VAT or other sales taxes unless expressly stated otherwise. If your payment method’s currency differs from the currency displayed on the Platform, your card issuer’s exchange rate and any associated fees may apply. Minor rounding differences may occur. - CANCELLATIONS AND REFUND POLICY
- User Cancellations
- Cancellations must be made directly through the Platform and are subject to the cancellation terms of the relevant Restaurant. Each Restaurant may determine its own cancellation windows (e.g., up to 24 or 48 hours prior to the reservation time), or may adopt the standard cancellation framework established by Table Quest.
- The applicable cancellation terms will be clearly disclosed at the time of booking and reiterated in your reservation confirmation. By placing a reservation, you acknowledge and agree to such terms as binding.
- Refund Entitlement
- If you cancel within the permitted cancellation window, you are entitled to a full refund of all pre-paid amounts for pre-ordered items. Refunds will be processed to the original payment method within fourteen (14) calendar days of approval; posting times by your bank or card issuer may vary
- If you cancel outside the permitted cancellation window (a “late cancellation”), or fail to appear at the scheduled reservation time (a “no-show”), the Restaurant may retain some or all pre-paid amounts as a cancellation or no-show fee, in accordance with the applicable policy. For example, a Restaurant may stipulate that cancellations within two (2) hours of the booking time or no-shows result in forfeiture of one hundred percent (100%) of the prepayment. Unless a stricter Restaurant-specific policy was clearly disclosed at booking, any retention of pre-paid amounts for late cancellations or no-shows shall be proportionate to (i) pre-ordered items already prepared and not reasonably resellable and (ii) any extraordinary procurement costs actually incurred.
- Default Rule. In the absence of a Restaurant-specific cancellation policy, the following default rule applies:
- cancellations made at least twenty-four (24) hours before the reservation time entitle you to a full refund;
- cancellations made less than twenty-four (24) hours before the reservation time, or no-shows, may result in forfeiture of all pre-paid amounts.
- where a reservation covers multiple guests and only part of the party attends, forfeiture applies only to the portion of pre-paid amounts attributable to the non-attending guests’ pre-ordered items.
- Discretionary Consideration. All refund determinations in cases of late cancellation or no-show remain at the sole discretion of the Restaurant, within the parameters of the policy presented at the time of booking. Table Quest will facilitate the technical process of refunding when a refund is authorized by the Restaurant. If you believe extenuating circumstances (such as a documented emergency or illness) apply, you may contact Table Quest Support. We will liaise with the Restaurant on your behalf, but we cannot guarantee any refund outside the stated policy.
- Restaurant Cancellations
- In rare cases, a Restaurant may cancel a confirmed reservation due to circumstances beyond its reasonable control (e.g., sudden closure, force majeure, or operational errors).
- If a Restaurant cancels your reservation, you will be notified promptly, and a full refund of all pre-paid amounts will be issued regardless of timing.
- Restaurants are not permitted to cancel confirmed reservations without a valid reason. Table Quest may, at its discretion, assist you in locating an alternative reservation, but does not guarantee replacement availability.
- User Cancellations
- NO-SHOW POLICY
- Definition of No-Show. A “no-show” occurs when a User fails to appear for a confirmed reservation without canceling in advance, or arrives so late that the Restaurant can no longer reasonably accommodate the reservation.
- User Obligations
- If you are unable to attend a reservation, you must cancel it within the applicable cancellation window via the Platform.
- In exceptional last-minute circumstances, you may contact the Restaurant directly; however, failure to properly cancel will result in your being recorded as a no-show.
- Consequences of No-Show
- In the event of a no-show, the Restaurant is entitled to retain up to one hundred percent (100%) of your pre-paid amount for pre-ordered items as a no-show fee. Such retention is intended to compensate the Restaurant for lost business and preparation costs.
- You shall not be entitled to any refund following a no-show, except in extraordinary cases where the Restaurant, in its sole discretion, authorizes such refund.
- A reservation will not be deemed a no-show if you arrive within a fifteen (15) minute grace period after the booked time, unless a different grace period was expressly stated at booking.
- If only part of the party attends, the Restaurant may seat the attending guests; any no-show fee shall not exceed the value of pre-ordered items for non-attending guests plus reasonable preparation costs actually incurred.
- Notifications and Disputes. Table Quest may notify you via email or in-app communication if our records indicate that you missed a reservation without cancellation. If you believe such notice has been issued in error, you must promptly contact Table Quest and follow the dispute instructions provided.
- Repeat Offenses
- Repeated no-shows (including multiple incidents within a twelve-month period) may result in suspension or permanent termination of your Table Quest account.
- Table Quest reserves the right to require advance deposits or restrict bookings to fully pre-paid reservations for Users with a documented history of no-shows.
- Continued no-show behavior after warnings may result in the disabling of your account without further notice.
- Check-In Requirement. Upon arrival at the Restaurant, it is your responsibility to identify yourself to the host or staff as holding a confirmed reservation (and, where applicable, a pre-paid order through Table Quest). Failure to check in may lead to being mistakenly recorded as a no-show.
- Definition of No-Show. A “no-show” occurs when a User fails to appear for a confirmed reservation without canceling in advance, or arrives so late that the Restaurant can no longer reasonably accommodate the reservation.
- USER RESPONSIBILITIES AND APPROPRIATE CONDUCT
- General Conduct. By accessing or using the Platform, you expressly acknowledge, represent, and warrant that you shall at all times conduct yourself in a respectful, lawful, and appropriate manner, both when interacting on the Platform and when attending our Partner Restaurants.
- Behavior at Restaurants
- You and your guests must arrive on time (or within any grace period expressly permitted by the Restaurant), comply with any applicable dress code, house rules, or policies, and treat the Restaurant’s staff, premises, and property with courtesy and respect.
- Restaurants reserve the right, without limitation, to refuse service, deny entry, or request your removal from the premises if you or your party engage in abusive, threatening, disruptive, or otherwise inappropriate conduct.
- In such circumstances, any pre-paid amounts may be deemed forfeited as liquidated damages to the extent permitted by the applicable cancellation/no-show policy and consumer law.
- Conduct on the Platform. You agree that you shall not, under any circumstances:
- use the Platform or Services for any unlawful, fraudulent, misleading, speculative, or bad-faith reservation;
- misrepresent your identity, affiliation, or authority, or post, transmit, or share any content that is defamatory, obscene, harassing, threatening, hateful, discriminatory, or otherwise objectionable;
- attempt to circumvent the Platform or its payment processes by arranging reservations, payments, or transactions with a Restaurant outside of the Platform, whether to avoid fees, commissions, or for any other purpose;
- engage in any data mining, scraping, crawling, or employ automated means not expressly provided by Table Quest to access, query, or extract data from the Platform;
- upload, distribute, or otherwise introduce malware, viruses, worms, Trojan horses, or any harmful or malicious code;
- attempt to probe, scan, or gain unauthorized access to the Platform, its systems, networks, or any user data.
- Enforcement and Remedies
- Any violation of this Section shall constitute a material breach of these Terms and may result, without limitation, in
- immediate suspension or termination of your Account,
- removal of any content you have submitted,
- forfeiture of pre-paid amounts, and
- pursuit of civil, equitable, or criminal remedies as may be available under applicable law.
- Table Quest reserves the right, in its sole discretion, to take any action it deems necessary to enforce these Terms, including but not limited to cooperating with law enforcement authorities and providing information relevant to suspected unlawful conduct.
- Any violation of this Section shall constitute a material breach of these Terms and may result, without limitation, in
- General Conduct. By accessing or using the Platform, you expressly acknowledge, represent, and warrant that you shall at all times conduct yourself in a respectful, lawful, and appropriate manner, both when interacting on the Platform and when attending our Partner Restaurants.
- ALLERGIES AND DIETARY REQUIREMENTS
- User’s Duty to Disclose. It is your sole responsibility to disclose in advance any food allergies, intolerances, or dietary restrictions affecting you or any member of your party. The Platform may provide a designated field or prompt during booking or pre-order checkout for such disclosures. You are strongly encouraged to use this feature; however, disclosure through the Platform does not relieve you of your obligation to reconfirm such information directly with the Restaurant’s staff upon arrival. Failure to adequately communicate allergies or dietary restrictions constitutes a material assumption of risk by you.
- Restaurant Responsibility. Each Restaurant remains independently responsible for:
- complying with applicable food safety laws and allergen disclosure regulations, and
- taking reasonable care in addressing guest dietary needs where feasible. Restaurants are contractually required by Table Quest to provide accurate menu information, including identification of common allergens where possible, and to use reasonable efforts to accommodate dietary requirements. Notwithstanding the foregoing, Table Quest does not verify, warrant, or guarantee the accuracy of menu descriptions, allergen disclosures, or the absence of allergens in any menu item.
- No Liability of Table Quest. By using the Platform, you expressly acknowledge and agree that:
- any allergy- or dietary-related interactions are strictly between you and the Restaurant;
- Table Quest acts solely as a facilitator of reservations and pre-orders, and not as the provider of food or beverages;
- Table Quest shall bear no liability, whether direct, indirect, consequential, or otherwise, for any allergic reactions, illness, personal injury, or other health issues that may result from food or beverages consumed at a Restaurant.
- For the avoidance of doubt, nothing in this Section 8 limits any rights you may have against the Restaurant under applicable consumer, product liability, or negligence laws, and nothing excludes liability that cannot be limited by law.
- Precautionary Measures. If you or any guest in your party has severe allergies, you are strongly advised to contact the Restaurant directly prior to your visit to ensure your needs can be safely accommodated. You remain solely responsible for exercising due caution and for verifying with the Restaurant that appropriate precautions have been taken.
- User’s Duty to Disclose. It is your sole responsibility to disclose in advance any food allergies, intolerances, or dietary restrictions affecting you or any member of your party. The Platform may provide a designated field or prompt during booking or pre-order checkout for such disclosures. You are strongly encouraged to use this feature; however, disclosure through the Platform does not relieve you of your obligation to reconfirm such information directly with the Restaurant’s staff upon arrival. Failure to adequately communicate allergies or dietary restrictions constitutes a material assumption of risk by you.
- REVIEWS AND USER-GENERATED CONTENT
- Eligibility. You may submit reviews, ratings, photos, or other content (“User Content”) only if you have personally attended the Restaurant pursuant to a completed reservation made through the Platform. Table Quest reserves the right to verify that User Content corresponds to an actual reservation and to remove content that does not meet this requirement.
- Content Standards. User Content must be honest, factual, and relevant to the dining experience. You agree not to submit any content that:
- is abusive, defamatory, obscene, harassing, discriminatory, threatening, or otherwise objectionable;
- discloses another person’s personal data (such as full names, phone numbers, or addresses) without authorization;
- infringes the intellectual property or privacy rights of any third party;
- is unrelated to the Restaurant or your dining experience.
- Prohibition of Misleading Reviews. You must not post false, fabricated, incentivized, or conflict-of-interest reviews, including reviews by Restaurant owners, employees, competitors, or agents posing as customers. Such conduct constitutes a material breach of these Terms and may result in removal of the content and suspension or termination of your Account.
- License to Table Quest. By submitting User Content, you grant Table Quest a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, adapt, publish, display, and distribute such content in connection with the operation, promotion, and improvement of the Platform. Table Quest may attribute your review to your first name or username, but will not disclose your personal contact details without your consent.
- Moderation Rights. Table Quest may, at its sole discretion, review, edit, or remove User Content that violates these Terms, our content guidelines, or applicable law, or if we determine in good faith that such action is reasonably necessary. Restaurants cannot directly remove User Content but may report reviews they believe to be false or defamatory; Table Quest will assess such reports impartially.
- User Responsibility. You remain solely responsible for any User Content you submit. You agree to indemnify and hold harmless Table Quest from any claims, damages, or liabilities arising from your User Content, including but not limited to claims of defamation or intellectual property infringement. Table Quest does not endorse any User Content, which represents solely the opinion of the individual author.
- Review Invitations and Media. After your reservation, you may be invited to submit a review. This is optional, but if provided, your review should focus on relevant aspects such as food, service, ambiance, or overall value. Photos must be your own, relevant to the dining experience, and free of third-party rights.
- Restaurant Responses. Restaurants may respond to User Content in a professional and respectful manner. Table Quest reserves the right to moderate or remove responses that violate these Terms or our content standards.
- Reporting & Appeals. If your review is reported, Table Quest will notify you with a summary of the claim and allow at least forty-eight (48) hours to respond and provide evidence. We will assess both sides impartially and inform you and the Restaurant of the outcome. In the absence of sufficient evidence to support removal, the content will remain published.
- Transparency of Moderation. If we remove or edit your review for policy reasons, we will notify you of the specific reason and provide a mechanism to appeal within fourteen (14) days.
- Content Reporting and Notice-and-Action.Any User, Restaurant, or third party may report allegedly unlawful or policy-violating content (including reviews) via the in-platform “Report” function or by contacting support@viditrack.com . Upon receipt of such a notice, Table Quest will:
- promptly acknowledge receipt of the notice;
- assess the reported content in good faith and in a timely manner;
- where removal or restriction is applied, provide the author of the content with a clear “statement of reasons,” including information on the decision, the legal or policy basis, and options for appeal;
- provide an internal complaint-handling mechanism through which both Users and Restaurants may contest moderation decisions within fourteen (14) days.
- Eligibility. You may submit reviews, ratings, photos, or other content (“User Content”) only if you have personally attended the Restaurant pursuant to a completed reservation made through the Platform. Table Quest reserves the right to verify that User Content corresponds to an actual reservation and to remove content that does not meet this requirement.
- INTELLECTUAL PROPERTY RIGHTS
- Ownership of Platform Content. All content, materials, and design elements made available through the Table Quest Platform, including without limitation text, graphics, logos, button icons, images, audio clips, software, databases, compilations, and overall look-and-feel (collectively, “Platform Content”), are and shall remain the exclusive property of Viditrack EOOD or its licensors, and are protected under applicable copyright, trademark, and other intellectual property laws. “Table Quest” and associated logos are trademarks and service marks of Viditrack EOOD.
- License Grant. Subject to strict compliance with these Terms, you are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform and Platform Content solely for your personal, non-commercial use in connection with making reservations and pre-orders. Any use of the Platform or Platform Content not expressly permitted herein is strictly prohibited and constitutes a material breach of these Terms.
- Restrictions. Without limitation, you shall not:
- copy, reproduce, modify, publish, transmit, distribute, display, or sell any portion of the Platform or Platform Content (other than your own User Content) without the prior express written consent of Table Quest;
- use the Table Quest name, logo, or trademarks in any manner not expressly authorized by us, including any use likely to cause confusion as to source, sponsorship, or affiliation;
- reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of any software or database associated with the Platform;
- employ automated means, bots, scripts, or data-mining techniques to scrape, index, or harvest the Platform or its Content, except as expressly permitted under our robots.txt or with our prior written authorization.
- Reservation of Rights. All rights not expressly granted to you under these Terms are hereby reserved by Table Quest and its licensors. No license, right, or interest is granted to you by implication, estoppel, or otherwise.
- Feedback. If you submit any feedback, ideas, or suggestions regarding the Platform, you acknowledge and agree that:
- such feedback is provided voluntarily and without expectation of compensation or confidentiality,
- Table Quest shall be free to use, disclose, reproduce, license, or otherwise exploit such feedback without restriction, and
- you shall not assert any claim of ownership or authorship over such feedback.
- User Content. Your User Content remains your property, subject always to the license granted to Table Quest under Section 9 (Reviews and User-Generated Content). You acknowledge and agree that Table Quest may preserve or disclose your User Content or related information if required by law, regulation, legal process, or in the good faith belief that such preservation or disclosure is reasonably necessary to:
- comply with applicable law,
- enforce these Terms,
- respond to claims of infringement or unlawful content, or
- protect the rights, property, or safety of Table Quest, its Users, or the public.
- Ownership of Platform Content. All content, materials, and design elements made available through the Table Quest Platform, including without limitation text, graphics, logos, button icons, images, audio clips, software, databases, compilations, and overall look-and-feel (collectively, “Platform Content”), are and shall remain the exclusive property of Viditrack EOOD or its licensors, and are protected under applicable copyright, trademark, and other intellectual property laws. “Table Quest” and associated logos are trademarks and service marks of Viditrack EOOD.
- PRIVACY AND DATA USE
- Privacy Policy. Your privacy is important to us. The Table Quest Privacy Policy (available on the Platform) explains in detail what personal data we collect, the lawful bases for such collection, how we use and protect that data, and your rights under applicable data protection laws. By using the Platform, you acknowledge and agree that you have read, understood, and accepted the Privacy Policy.
- Data Sharing with Restaurants
- When you place a reservation or pre-order, Table Quest will share the necessary information to facilitate your booking with the relevant Restaurant. This may include, without limitation, your name, reservation details (date, time, and number of guests), pre-ordered items, and any notes you provide (such as allergy disclosures or special requests).
- Your contact information (e.g., phone number) may also be shared where reasonably necessary for last-minute communication regarding your reservation.
- Each Restaurant acts as an independent data controller for such information and is solely responsible for handling it in compliance with applicable data protection laws (including, without limitation, the EU General Data Protection Regulation “GDPR”). Restaurants are contractually prohibited from using your data for purposes unrelated to fulfilling your reservation, unless you have separately provided consent (e.g., to receive marketing directly from the Restaurant).
- Marketing Communications
- With your prior consent, Table Quest may send you promotional communications (including emails, in-app messages, or push notifications) relating to special offers, new Restaurant partners, or other news. You may withdraw your consent and opt out at any time by following the unsubscribe link provided in our communications or by adjusting your account settings.
- Operational communications relating to your reservations, account status, or updates to these Terms are service-essential and cannot be opted out of, as they are necessary for the performance of our Services.
- Cookies and Tracking Technologies. The Platform uses cookies and similar technologies to improve functionality, enhance your user experience, and perform analytics. Details of these technologies and your options for managing them are described in our Cookie Policy. By continuing to use the Platform, you acknowledge and agree to our use of cookies and tracking technologies as described therein.
- Data Security. Table Quest implements appropriate technical and organizational measures designed to protect your personal data against unauthorized access, accidental loss, alteration, or disclosure. Notwithstanding the foregoing, no transmission or storage system can be guaranteed as fully secure. You are responsible for safeguarding your account credentials and for promptly notifying us at [support@Table Quest.com] if you suspect unauthorized access or misuse of your account. For the avoidance of doubt, Table Quest will never request your password by phone, email, or other unsolicited communication.
- Disclaimer of Liability for Third-Party Processing. To the maximum extent permitted by law, Table Quest disclaims responsibility for the actions or omissions of Restaurants or other third parties in relation to your personal data once it has been lawfully transmitted to them for the purpose of fulfilling your reservation.
- Data Retention and Deletion. Data Retention and Deletion. We retain reservation and transaction metadata for up to twenty-four (24) months for fraud prevention, accounting, and legal compliance. Payment records are retained for up to five (5) years where required by tax or financial regulations. Review content is retained for two (2) years or until removal, whichever is longer, as part of the Platform’s historical record. Account metadata (including login and profile information) is retained for up to twelve (12) months after account deletion. You may request deletion of your personal data in accordance with our Privacy Policy; we may retain certain data where required by law (e.g., tax, audit, and regulatory obligations).
- Privacy Policy. Your privacy is important to us. The Table Quest Privacy Policy (available on the Platform) explains in detail what personal data we collect, the lawful bases for such collection, how we use and protect that data, and your rights under applicable data protection laws. By using the Platform, you acknowledge and agree that you have read, understood, and accepted the Privacy Policy.
- LIMITATIONS OF LIABILITY
- Use of Services “As-Is.” The Platform and Services are provided strictly on an “as is” and “as available” basis. While Table Quest strives to maintain a high level of quality, accuracy, and reliability, we make no representation or warranty, express or implied, that:
- the Platform will be uninterrupted, timely, secure, or error-free;
- the content, including Restaurant menus, availability, or pricing, will always be accurate, complete, or current; or
- defects will be corrected immediately. Restaurants are solely responsible for their own information, and Table Quest expressly disclaims liability for errors, omissions, or inaccuracies in Restaurant-provided content.
- Intermediary Role. Table Quest acts solely as an intermediary, facilitating reservations and pre-orders. We are not responsible or liable for the actual dining experience at any Restaurant. Without limitation, any issues or claims concerning food, beverages, service, premises, accidents, allergic reactions, personal injuries, illness, or dissatisfaction with the dining experience are exclusively between you and the Restaurant. You may notify us of serious issues, and we may, at our sole discretion, attempt to mediate or assist in resolution; however, such efforts do not create any liability for Table Quest.
- No Warranty for Specific Outcomes. Table Quest does not guarantee that a reservation will always be honored, that all pre-ordered items will be available, or that such items will be prepared in exact accordance with descriptions. Responsibility for menu changes, ingredient availability, and food preparation rests with the Restaurant. In cases of unavailability, the Restaurant is expected to inform you and provide a suitable alternative or refund.
- Service Interruptions and Technical Issues. Table Quest disclaims liability for interruptions, delays, or technical malfunctions of the Platform, including but not limited to reservation opportunities lost, downtime, bugs, viruses, or compatibility issues. You are responsible for maintaining secure networks and keeping your software up to date when accessing the Platform, including installing and maintaining appropriate antivirus protection.
- Limitation of Financial Liability. Limitation of Financial Liability. To the maximum extent permitted by law, the aggregate liability of Table Quest, Viditrack EOOD, and its officers, directors, employees, and agents for any claims, whether in contract, tort (including negligence), statute, or otherwise, shall not exceed the greater of:
- the total service fees (if any) paid by you directly to Table Quest in the twelve (12) months preceding the claim; or
- EUR €500.
- This limitation does not exclude or restrict liability where such limitation is prohibited by law, including liability for death or personal injury caused by gross negligence, or for fraud or fraudulent misrepresentation.
- Consumer Rights. Nothing in these Terms is intended to exclude or limit your statutory consumer rights under the laws of your country of residence. These Terms shall be interpreted in compliance with applicable consumer protection legislation. For the avoidance of doubt, where EU law grants a general 14-day withdrawal right for online services, such right does not apply to Restaurant reservations for a specific date and time, which are exempt as leisure services. Refunds and cancellations are governed exclusively by the cancellation and refund policies applicable at the time of booking.
- Indemnification. You agree to indemnify, defend, and hold harmless Table Quest (Viditrack EOOD), its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising out of or relating to:
- your breach of these Terms or any applicable law;
- your violation of the rights of any third party, including but not limited to intellectual property or privacy rights; or
- your intentional misconduct or negligence in connection with your use of the Services or while attending a Restaurant.
- This indemnity shall not apply to the extent a claim arises directly from Table Quest’s own gross negligence or willful breach of these Terms
- Use of Services “As-Is.” The Platform and Services are provided strictly on an “as is” and “as available” basis. While Table Quest strives to maintain a high level of quality, accuracy, and reliability, we make no representation or warranty, express or implied, that:
- SUSPENSION AND TERMINATION
- By Table Quest. Table Quest may, in its sole discretion and without limitation, suspend, restrict, disable, or terminate your Account or access to some or all of the Services, with or without prior notice, if:
- you commit a material breach of these Terms or any applicable law;
- you engage in fraudulent activity, misuse of the Platform, or other prohibited conduct (including but not limited to repeated no-shows, fake or conflict-of-interest reviews, or illegitimate payment disputes);
- you provide false, misleading, or unverifiable information, or we are unable to authenticate details you have provided; or
- your conduct poses or may reasonably pose harm, liability, or risk to other Users, Restaurants, partners, or the integrity of the Platform.
- Except in cases of fraud, willful misconduct, or imminent risk to other Users, Restaurants, or the integrity of the Platform, Table Quest shall provide you with at least seven (7) calendar days’ prior notice of termination or suspension of your Account, together with a brief statement of reasons. You may use this period to contact Table Quest and, where appropriate, remedy the issue. Immediate termination without notice may still occur in cases of serious breaches, including fraudulent activity, illegal conduct, or data security threats. Termination of your Account shall include automatic cancellation of any pending reservations. Refunds, if any, will be processed strictly in accordance with the applicable cancellation or refund policies. Following termination, you may not re-register or create a new Account without prior written consent from Table Quest.
- By You. You may discontinue use of the Platform and/or request deletion of your Account at any time by contacting us at [support@Table Quest.com] or using any account deletion functionality provided within the Platform. Account deletion will remove your profile and personal data as described in our Privacy Policy. These Terms, however, shall continue to apply with respect to all prior use of the Platform, including any disputes, claims, or liabilities arising from past transactions or conduct. If you have active reservations at the time of termination, you remain responsible for canceling them in accordance with the applicable cancellation policy; failure to do so may result in charges or forfeiture of prepaid amounts.
- Effect of Termination. Upon termination of your Account for any reason:
- all rights and licenses granted to you under these Terms shall immediately cease;
- your access to the Platform may be disabled without further notice; and
- Table Quest may, but is not obligated to, retain records of your Account and transactions as permitted or required by law.
- Survival of Provisions. The following sections of these Terms shall survive termination of your Account and remain in full force and effect: Intellectual Property Rights; Privacy and Data Use; Limitations of Liability; Indemnification; Governing Law; Dispute Resolution, together with any other provision which by its nature is intended to survive.
- By Table Quest. Table Quest may, in its sole discretion and without limitation, suspend, restrict, disable, or terminate your Account or access to some or all of the Services, with or without prior notice, if:
- GOVERNING LAW AND DISPUTE RESOLUTION
- Governing Law. These Terms, and any dispute, controversy, or claim arising out of or in connection with them, their subject matter, or your use of the Services (whether in contract, tort, statute, or otherwise), shall be governed by and construed in accordance with the laws of Bulgaria, without regard to conflict of law principles. If you are a consumer resident in another European Union Member State, you will continue to benefit from any mandatory consumer protection provisions of your country of residence, and nothing in these Terms shall deprive you of such protections.
- Amicable Resolution. In the event of any dispute, you agree to first contact Table Quest Customer Support in good faith to seek an amicable resolution. Table Quest shall make reasonable efforts to resolve disputes promptly and informally, before escalating them to legal proceedings.
- Jurisdiction. Subject to paragraph 14.1, you irrevocably agree that the courts of Bulgaria shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms, your Account, or your use of the Services. If you are a consumer resident in the European Union, you may additionally be entitled to bring proceedings in your local courts and in your local language as permitted by applicable law.
- Alternative Dispute Resolution. The European Commission provides an Online Dispute Resolution (“ODR”) platform, accessible at https://ec.europa.eu/consumers/odr, which may assist in resolving consumer disputes.. While Table Quest is not obligated to submit to any specific alternative dispute resolution (“ADR”) procedure, except where mandated by law, we shall consider in good faith any reasonable request to engage in mediation, arbitration, or other ADR mechanisms as an alternative means of dispute resolution.
- Survival. This Section shall survive termination of your Account and remain in full force and effect.
- Governing Law. These Terms, and any dispute, controversy, or claim arising out of or in connection with them, their subject matter, or your use of the Services (whether in contract, tort, statute, or otherwise), shall be governed by and construed in accordance with the laws of Bulgaria, without regard to conflict of law principles. - SEARCH & RANKING TRANSPARENCY
- Ranking Parameters. Restaurant listings and search results on the Platform are ranked primarily based on objective criteria, including:
- relevance to the User’s query and filters,
- location and availability,
- overall rating and recency of reviews, and
- completeness and accuracy of the Restaurant’s profile information.
- Promotions and Sponsored Placements. Restaurants may choose to participate in optional paid promotional services. Where such promotions are applied, they are clearly labeled as “Sponsored” or equivalent, and may influence visibility in search results without altering the underlying organic ranking parameters.
- Neutrality of Non-Participation. A Restaurant’s decision not to participate in paid promotions shall not negatively affect its organic ranking on the Platform.
- Ranking Parameters. Restaurant listings and search results on the Platform are ranked primarily based on objective criteria, including:
- CHANGES TO THE TERMS
- Modifications. Table Quest reserves the right to modify, amend, or update these Terms from time to time. If material changes are made, Table Quest will provide notice through reasonable means, including, without limitation, via email or through the Platform (e.g., by posting a prominent notice or requiring affirmative acceptance of the updated Terms).
- Acceptance of Changes. Continued use of the Services after updated Terms take effect shall constitute your acknowledgment and binding acceptance of such modifications. If you do not agree to any changes, you must immediately cease using the Services and may request deletion of your Account.
- Transaction-Specific Terms. For the avoidance of doubt, the version of the Terms in effect at the time of your reservation or transaction shall govern such transaction, unless otherwise required by applicable law.
- Modifications. Table Quest reserves the right to modify, amend, or update these Terms from time to time. If material changes are made, Table Quest will provide notice through reasonable means, including, without limitation, via email or through the Platform (e.g., by posting a prominent notice or requiring affirmative acceptance of the updated Terms).
- MISCELLANEOUS
- Entire Agreement. These Terms, together with the Privacy Policy, Cookie Policy, and any additional guidelines, policies, or rules communicated to you (including, without limitation, cancellation policies or promotion terms), constitute the entire agreement between you and Table Quest regarding your use of the Services and supersede all prior agreements, communications, or understandings, whether written or oral, relating to the same subject matter.
- No Waiver. The failure of Table Quest to enforce any provision of these Terms shall not constitute a waiver of such provision or of any other rights. Any waiver or consent by Table Quest must be in writing and signed by an authorized representative to be legally effective.
- Severability. If any provision of these Terms is held invalid, illegal, or unenforceable by a competent court or authority, such provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect. Table Quest may replace any invalid or unenforceable provision with a valid and enforceable one that most closely reflects the original intent.
- Independent Contractors. You and Table Quest are independent contracting parties. Nothing in these Terms shall be deemed to create any joint venture, partnership, agency, employment, fiduciary, or franchise relationship between you and Table Quest. You are not authorized to bind or represent Table Quest in any capacity.
- Assignment. You may not assign, delegate, or otherwise transfer your rights or obligations under these Terms without the prior written consent of Table Quest. Table Quest may assign or transfer its rights and obligations under these Terms, in whole or in part, to any affiliate, successor, or acquirer, including in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of its assets, without restriction, provided that such transfer does not materially diminish your rights under these Terms.
- Headings. Section and paragraph headings are included for convenience only and shall not affect the meaning, interpretation, or enforceability of these Terms.
- Entire Agreement. These Terms, together with the Privacy Policy, Cookie Policy, and any additional guidelines, policies, or rules communicated to you (including, without limitation, cancellation policies or promotion terms), constitute the entire agreement between you and Table Quest regarding your use of the Services and supersede all prior agreements, communications, or understandings, whether written or oral, relating to the same subject matter.
